Commercial Notice
Commercial electronic messages may only be sent with prior consent recorded in the IYS system. Recipients can withdraw consent at any time. Service-related, contractual, or legally required messages are exempt. Traders and artisans may also opt out. Consent enables the Company to send campaigns, promotions, surveys, and announcements through SMS, email, or phone.
Commercial Notice
Pursuant to Law No. 6563 on the Regulation of Electronic Commerce and the relevant legislation, a Commercial Electronic Message refers to messages containing data, voice, and images transmitted for commercial purposes through electronic means such as phone, call centers, fax, automated calling machines, smart voice recording systems, email, and short message services. The individuals or groups targeted or to whom these messages are sent are referred to as “Recipients.”
Commercial Electronic Messages may only be sent to Recipients with their prior consent in accordance with the applicable legislation. Commercial Electronic Messages cannot be sent to Recipients whose consent is not recorded in the Commercial Electronic Message Management System (“IYS”) (www.iys.org.tr). Explicit consent can be obtained in writing, electronically, or through the IYS. Consents obtained through the IYS include a positive declaration of consent and the electronic communication address. Recipients may withdraw their consent for receiving Commercial Electronic Messages at any time without providing any justification.
When a Recipient completes a proposal form to receive services from the Company or contacts the Company to submit a request or complaint related to the Company’s services, messages sent to the communication information provided by the Recipient for these limited purposes are exempt from the requirement for explicit consent. Commercial Electronic Messages directly related to the performance of a contract do not require separate consent. Notifications and messages necessary for the performance of services are exempt from the requirement for explicit consent. Similarly, messages sent as part of the Company's legal obligations under the applicable legislation are also exempt.
It is not mandatory to obtain prior consent for Commercial Electronic Messages sent to the electronic communication addresses of traders and artisans. However, if such Recipients exercise their right to opt out as specified in the relevant legislation, Commercial Electronic Messages cannot be sent to these Recipients without obtaining their consent again.
If Recipients provide their consent, the Company may use communication tools such as SMS, email, phone, fax, call centers, etc., to communicate with Recipients for purposes including providing information, promotions, advertisements, product offers, campaigns, satisfaction surveys, and announcements related to the services provided by the Company.
According to the applicable legislation, Recipients who agree to receive Commercial Electronic Messages may withdraw this consent at any time, free of charge, by using the relevant link provided in the Commercial Electronic Message, contacting the Company via (info@happyplacetowork.com), or updating their preferences through the IYS. If explicit consent is withdrawn, all other messages not directly related to the performance of services and contractual obligations (such as promotions, advertisements, product/service offers, campaigns, surveys, announcements, etc.) will not be sent to the Recipient via the channel(s) through which the opt-out right was exercised.
